These Terms and Conditions (“Terms”) govern your use of the website and services provided by Splitdeal ABN:71 607 014 004 (“Splitdeal”, “we”, “us”, or “our”). By accessing, browsing, or using our website located at www.splitdeal.com (“Website”), you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website or any of our services.
1. DEFINITIONS
“Platform” refers to the SplitDeal website, applications, and related services.
“Customer”, “you”, or “your” means the individual accessing or using the Platform.
“Brand Partner” means a third-party business listing or supplying products on the Platform.
“Group Deal” means a promotional product listing offered at a discounted rate, activated only when a minimum number of customers (“Target Quantity”) have committed to purchasing within a specified timeframe.
2. ELIGIBILITY
2.1 You must be at least 18 years of age to register an account and participate in group deals on the Platform. By using the Platform, you represent and warrant that you are at least 18 years old.
3. ACCOUNT REGISTRATION
3.1 To access and participate in Group Deals, you may be required to register for an account.
3.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 You agree to provide accurate and current information and to update it as required.
4. HOW SPLITDEAL WORKS
4.1 SplitDeal operates as a collective group-buying platform, allowing customers to express interest in, or commit to purchasing, products listed by Brand Partners.
4.2 A Group Deal is only activated if the Target Quantity of committed buyers is met within the specified campaign timeframe.
4.3 Once the Target Quantity is reached:
- Customers’ payment methods will be charged for the product amount (less any upfront fees already paid); and
- The Brand Partner will fulfil the order directly or via its authorised agents.
4.4 If the Target Quantity is not reached:
- Customers will not be charged for the product.
- However, any upfront platform or commitment fee paid may be retained in accordance with Clause 5.
5. FEES AND PAYMENT
5.1 Customers may be required to pay a non-refundable commitment fee at the time of joining a Group Deal. This fee helps cover platform, payment, and administrative costs and is clearly disclosed before joining.
5.2 Payment for products is processed via third-party payment providers (e.g. Stripe). Splitdeal does not store credit card details.
5.3 If a Group Deal is activated, the remaining product balance will be charged to the customer, and the order will be forwarded to the Brand Partner for fulfilment.
5.4 Pricing is in Australian Dollars (AUD) and includes GST unless stated otherwise.
6. ORDER FULFILMENT
6.1 Product orders are fulfilled directly by the Brand Partner. SplitDeal is not the seller of the product.
6.2 Shipping terms, timeframes, and delivery options will be stated at the time of purchase and are managed by the Brand Partner.
6.3 SplitDeal is not liable for delivery delays, damages, or fulfilment issues once the order is transferred to the Brand Partner.
7. CANCELLATIONS, REFUNDS & RETURNS
7.1 Once a Group Deal is activated and payment is processed, orders cannot be cancelled by the customer unless otherwise permitted under the Australian Consumer Law.
7.2 All requests for refunds, replacements, or warranty claims must be directed to the Brand Partner.
7.3 If a product is faulty, not as described, or not fit for purpose, the Brand Partner is responsible for complying with their obligations under consumer law.
7.4 SplitDeal may assist in mediating between customers and Brand Partners but does not assume responsibility for product returns or warranty outcomes.
8. CUSTOMER RESPONSIBILITIES
8.1 You agree not to misuse the Platform, including but not limited to:
- Using false information to create accounts;
- Attempting to manipulate or hack Group Deal mechanics;
- Uploading offensive, misleading, or unlawful content;
- Attempting to reverse engineer or copy the platform.
9. INTELLECTUAL PROPERTY
9.1 All content on the Platform, including text, images, logos, branding, software, layout and features, are the intellectual property of Splitdeal or its licensors.
9.2 You may not copy, reproduce, modify, distribute, or create derivative works of any content on the Platform without our prior written permission.
10. LIMITATION OF LIABILITY
10.1 To the extent permitted by law, Splitdeal excludes all liability for any loss or damage (including indirect, incidental, or consequential loss) arising from:
- Your use of the Platform;
- Delays or failures in activating a Group Deal;
- Actions or omissions of Brand Partners;
- Errors in product descriptions or images;
- Technical issues or outages.
10.2 Where liability cannot be excluded, it is limited to the resupply of the relevant service or refund of the price paid for the product.
11. PRIVACY
11.1 Your use of the Platform is subject to our Privacy Policy, which outlines how we collect, use, store, and share your personal information.
11.2 You acknowledge and agree that customer information (e.g. name, email, shipping address) will be shared with Brand Partners solely for the purpose of fulfilling successful Group Deal orders.
12. THIRD-PARTY LINKS
12.1 The Platform may contain links to third-party websites. We are not responsible for the content or privacy practices of those websites and provide them only for your convenience.
13. TERMINATION
13.1 We may suspend or terminate your access to the Platform at our discretion if we believe you have breached these Terms or engaged in conduct that may harm SplitDeal or its users.
14. CHANGES TO TERMS
14.1 We may modify these Terms from time to time. Updated Terms will be posted on the Website, and continued use of the Platform after changes are made constitutes acceptance of the revised Terms.
15. GOVERNING LAW
15.1 These Terms are governed by the laws of Victoria, Australia. Any disputes arising out of or in connection with these Terms shall be resolved in the courts of Victoria.
